NEW CONSTRUCTION BUYING PROCESS
GET PRE-APPROVED
Get a pre-approval letter within 60 days from the date of signing the agreement of purchase and sale. Speak to a mortgage specialist in New-Construction, and don not wait until the last minute before clsoing to secure rates and terms.
SUBMIT A WORKSHEET
Submitting a worksheet does not guarantee you a unit to purchase. If the Builder can allocate a unit based on your selection, you will be given an opportunity to move forward with the purchase. Units are not to be placed on hold. This window is limited, and time is of the essence. The more flexible you are in your unit choices, the better your chances of reserving a unit.
SIGN AGREEMENT
After you have secured a unit, you will receive an Agreement of Purchase and Sale to sign digitally or in person.
PROVIDE DEPOSIT
Once you sign the Agreement of Purchase and Sale the deposit and posted cheques are required, this is when your APS will be executed by the builder. Upon receipt of the fully executed agreement and disclosure documents, you will enter the 10-day cooling-off period.
HOME WARRANTY
By law, every new home built requires a New Home Warranty by the builder. The warranty starts with the executed date of the Agreement of Purchase and Sale and remains in effect for up to 7 years even if the home is SOLD.
CLOSING
Prior to closing you will do a final walk-thru with the builder’s representative and look for any incomplete or deficiencies in the work and make a detailed list which will be addressed in the coming weeks. Once the transfer of funds has happened from the lawyer, you will receive the keys to your new home.
QUALIFY YOUR LAWYER
A good lawyer will review the documents early, deal with a large volume of new-construction contracts and closings, understand the needs of investors and end-users, and know their numbers. It is imperative to work with a Real Estate Lawyer who specializes in New Construction.
10 DAY COOLING OFF PERIOD
When you receive your executed APS, all purchases are provided by law a 10-day cooling-off period. These are 10 calendar days, not business days. This is a critical time to do your due diligence and have a real estate lawyer review your APS before the end of the 10-day cooling period.
